These Terms of Service ("Terms") govern your access to and use of Collab Creator AI (the "Service"), operated by Collab Creator AI ( "we", "us", "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a binding contract. If you use the Service on behalf of an organisation, you represent that you have authority to bind that organisation.
2. The Service
Collab Creator AI provides trend intelligence, AI-assisted script generation, faceless video and image creation tools, and optional publishing integrations for YouTube, Instagram, and TikTok. Features vary by subscription tier. We may modify, suspend, or discontinue features with reasonable notice where practicable.
3. Accounts
You are responsible for safeguarding your login credentials and for all activity under your account. Notify us promptly at admin@collab-creator.co.uk if you suspect unauthorised access.
4. Acceptable use
Your use of the Service is subject to our Acceptable Use Policy. You may not use the Service to violate law, infringe intellectual property, distribute malware, harass others, or generate unlawful or harmful content.
5. Collab Creator AI-generated content
Outputs produced by the Service (scripts, videos, metadata suggestions) are generated automatically. You are solely responsible for reviewing, editing, and publishing any content. We do not guarantee accuracy, originality, or suitability for any platform's policies (including YouTube, Instagram, and TikTok). You must comply with applicable platform rules and disclosure requirements for AI-assisted content where required.
6. Third-party services
The Service integrates with third parties including YouTube, Instagram, TikTok, Stripe, and cloud AI providers. Your use of those services is subject to their respective terms. We are not responsible for third-party outages, policy changes, or data handling beyond our control.
7. Subscriptions and payment
Paid plans (Basic and Pro) are billed in advance on a recurring basis via Stripe unless otherwise stated. Prices are shown at checkout and may change with notice for future billing periods. Taxes may apply. Basic and Pro plans include a 14-day money-back guarantee for initial purchases. Refunds and cancellations are governed by our Refund & Cancellation Policy.
8. Intellectual property
We retain all rights in the Service, software, branding, and documentation. Subject to these Terms and your plan limits, we grant you a limited, non-exclusive, non-transferable licence to use the Service for your internal creator activities. You retain ownership of content you upload; you grant us a licence to process that content solely to provide the Service.
9. Confidentiality and data
Our collection and use of personal data is described in our Privacy Policy. You must not misuse other users' data obtained through the Service.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION OR THAT OUTPUTS WILL ACHIEVE ANY PARTICULAR RESULT (E.G. VIEWS, REVENUE, OR MONETISATION).
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, COLLAB CREATOR AI AND ITS DIRECTORS, EMPLOYEES, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) £100.
Nothing in these Terms excludes liability that cannot be excluded under applicable law (including fraud or death/personal injury caused by negligence where applicable).
12. Indemnity
You will indemnify and hold us harmless from claims, damages, and expenses (including reasonable legal fees) arising from your content, your breach of these Terms, or your violation of law or third-party rights.
13. Termination
You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms, pose a security risk, or where required by law. On termination, your right to use the Service ends; provisions that by nature should survive (including liability limits, indemnity, and governing law) will survive.
14. Governing law
These Terms are governed by the laws of England and Wales, without regard to conflict-of-law rules. The courts of England and Wales shall have exclusive jurisdiction, except where mandatory consumer protection laws in your country give you the right to bring proceedings in your local courts.
15. Changes
We may update these Terms from time to time. We will post the revised version with an updated date. Material changes will be notified via the Service or email where appropriate. Continued use after the effective date constitutes acceptance.
